Court turns down campaign disclosure challenge
Legal Career News | 2011/02/23 14:48

The Supreme Court has rejected an appeal challenging campaign disclosure laws in Washington state.

The court on Tuesday let stand without comment a federal appeals court ruling that upheld the state's disclosure requirements. Human Life of Washington challenged the requirements as a violation of the First Amendment. The group didn't want to reveal its donors in a 2008 campaign opposing an assisted suicide ballot measure.

The San Francisco-based 9th U.S. Circuit Court of Appeals said the disclosure requirements "have become an important part of our First Amendment tradition."

Thurman stalker seeks plea deal in new NYC case
Court Feed News | 2011/02/23 11:49

Uma Thurman's convicted stalker is trying to work out a plea deal after a Manhattan court refused to toss out or pare down charges that he flouted a court order by trying to contact her again.

A judge said Wednesday there was enough evidence to support the new contempt, stalking and other charges against Jack Jordan.

Jordan's lawyer and prosecutors say they're discussing the possibility of a plea deal but haven't reached any agreement.

Jordan was convicted in 2008 of stalking and harassing the "Pulp Fiction" actress. He was sentenced to three years' probation and told not to try to contact her for five years.

Prosecutors say he called some of Thurman's phone lines and demanded to speak to her twice in October.

Utah's high court upholds ex-mayor's case
Court Feed News | 2011/02/22 16:50

The Utah Supreme Court has upheld a lower court ruling that allows the former mayor of Eagle Mountain to sue the city for legal fees incurred during his embezzlement trial.

The Salt Lake Tribune reports the ruling was issued on Friday. The ruling allows a civil lawsuit to go forward in 4th District Court.

In 2008, Brian B. Olsen was acquitted in a misuse of public funds case. Olsen sought $120,000 in legal fees from the city. He sued in 2009, claiming state law provides for the payment of legal fees when a public official is prosecuted and acquitted.

Eagle Mountain contests Olsen's demand for fees and contends he didn't seek didn't submit a timely request for the city to defend him at trial, as is required under Utah law.

High court rejects appeal over divided jury
Court Feed News | 2011/02/22 16:48

The Supreme Court has rejected an appeal from a defendant who was convicted of attempted murder in Louisiana by a jury's 10-2 vote.

The justices acted without comment Tuesday in turning down a plea from Troy Barbour to require juries in all criminal trials to reach unanimous verdicts to convict. Two states, Louisiana and Oregon, allow defendants to be convicted of most crimes despite disagreement among jurors.

Those states rely on a nearly 40-year-old Supreme Court ruling that mandates unanimous verdicts in federal, but not state, criminal trials.

Judge on federal appeals court in Calif. dies
Attorneys News | 2011/02/22 11:48

Federal court officials say a senior judge on the 9th U.S. Circuit Court of Appeals in San Francisco has died after an illness. Judge David R. Thompson was 80.

Officials say Thompson, of San Diego, died Saturday in San Francisco, where he was in town to hear oral arguments in several cases.

He was nominated to the appeals court by President Ronald Reagan and was appointed in December 1985. The court says he ranked 19th in seniority among its 48 active and senior judges.

Before he became a judge, Thompson's private law practice was in business litigation and general trials. He also served for three years on a committee that advises the judiciary's national governing body.
