Authorities say he used the money to buy luxury cars and homes in Manhattan, Brooklyn and New Jersey.

According to court papers, Foster siphoned funds from various Citigroup accounts and wired the money into his private account at another bank.

NY jail guard pleads guilty to murders, kidnapping
Criminal Law Updates | 2011/09/07 11:49
A New York jail guard has pleaded guilty to murder and other charges for killing her ex-girlfriend and uncle, and wounding her grandfather.

Kim Wolfe entered the plea Wednesday to two counts of murder, one count of kidnapping, assault and a weapons charge. The judge said he will sentence her to 22 years to life on Nov. 2.

Stacie Williams, a 45-year-old nurse's aide, was gunned down last year outside the Nassau University Medical Center in East Meadow on Long Island. The pair had met to discuss a possible reconciliation.

Wolfe then went to a relative's home about three miles away in Hempstead. There, she killed her uncle, wounded her 88-year-old grandfather and took a 23-year-old niece hostage following a dispute over life insurance policies. The niece was not harmed.

Calif court mulls appeal rights of Prop 8 backers
Legal Career News | 2011/09/07 10:45

California's same-sex marriage ban endured its latest legal test Tuesday as the state's high court grilled attorneys on whether Proposition 8's backers have legal authority to appeal a federal ruling that overturned the voter-approved measure.

The tenor of the justices' questioning during the more than hour-long hearing often leaned in favor of arguments by backers of the ban, who argue that the state Constitution gives ballot initiative proponents legal authority to defend their measures in court.

On that critical question, several justices noted that the California Supreme Court always has, as a matter of practice if not written policy, allowed the sponsors of ballot questions to appear before it when their measures were challenged.

"Never in any recorded (case) have proponents been denied the right to advance their interests," Associate Justice Kathryn Werdegar noted during the closely watched arguments. "The present state of California law is we allow liberal intervention."

The Supreme Court is examining the scope of the power afforded the official backers of ballot initiatives at the request of a federal appeals court that is reviewing a federal judge's year-old ruling that Proposition 8 violates the constitutional rights of same-sex couples.

The 9th U.S. Circuit Court of Appeals has expressed doubts about the ability of Proposition 8's sponsors to challenge the lower court ruling absent the involvement of California's governor or attorney general, both of whom agreed the ban was unconstitutional and refused to appeal.

EU court puts limits on modified honey
Business Law Info | 2011/09/07 09:48

Honey that contains traces of pollen from genetically modified crops needs special authorization before it can be sold in Europe, the European Union's top court said Tuesday, in a judgment that could have widespread consequences on the bloc's policy on genetically modified organisms, or GMOs.

The ruling from the European Court of Justice came after several Bavarian beekeepers demanded compensation from their government for honey and food supplements that contained traces of pollen from genetically modified maize.

The beekeepers had their hives close to fields where the Bavarian government was growing Monsanto's MON 810 maize for research purposes.

The EU has strict guidelines on authorizing and informing consumers about foods containing GMOs — a policy that has caused problems for producers of genetically modified seeds such as U.S.-based Monsanto Co. that are used to much laxer rules in other parts of the world.

Kelli Powers, a spokeswoman for Monsanto, said the company could not provide detailed comment on the ruling until the firm had a chance to read the entire judgment.

But Powers emphasized that the company's engineered corn seed has been approved as safe for human consumption.

Calif. gay marriage ban faces next legal hurdle
Headline News | 2011/09/06 16:17
California's same-sex marriage ban faces its next legal test Tuesday when the state's highest court attempts to shed light on whether the voter-approved measure's backers have legal authority to appeal the federal ruling that overturned Proposition 8.

The California Supreme Court is scheduled to hear an hour of arguments on that question, which could prove crucial to the future of the voter-approved ban. The federal appeals court that is considering the initiative's constitutionality wants the state court to weigh in on the matter before it issues its decision.

The 9th U.S. Circuit Court of Appeals has expressed doubts about the ability of Proposition 8's sponsors to challenge the lower court ruling absent the involvement of California's governor or attorney general, both of whom refused to appeal a federal judge's August 2010 decision striking down the ban as a violation of gay Californians' civil rights.

The court punted the question to the California Supreme Court earlier this year, saying it was a matter of state law.

Lawyers for the coalition of religious and conservative groups that qualified Proposition 8 for the November 2008 ballot maintain they are legally eligible to represent the majority of California voters who approved the same-sex marriage ban. They argue that because California has such a vigorous citizen's initiative process, it would not make sense for elected officials to effectively veto measures by not defending them in court.
