Court won't hear challenge to 'So help me God'
Legal Career News | 2011/05/16 13:25

The Supreme Court is brushing aside an atheist's challenge to religion in government, refusing to hear a complaint about President Barack Obama adding "so help me God" to his inaugural oath of office.

The high court on Monday refused to hear an appeal from Michael Newdow, who argued that government references to God are unconstitutional and infringe on his religious beliefs.

Many presidents have added "so help me God" to the oath.

Newdow sued to keep Obama from doing so and lost. He wanted overturned an appeals court's ruling saying it would be useless to ban Chief Justice John Roberts from prompting Obama to say "so help me God" because the president could have easily found someone else to administer the oath.

2 sports gear firm execs charged in fraud scheme
Criminal Law Updates | 2011/05/14 18:27
Two former executives of a sports equipment company were charged Wednesday with fraud for allegedly swindling dozens of schools in northern New Jersey by forging fake bids from competitors, inflating invoices and courting school officials with gifts.

Mitchell Kurlander of Allentown, Pa., and father-in-law Alan Abeshaus of Highland Beach, Fla., made initial appearances in federal court in Newark on Wednesday afternoon. They each face a conspiracy count, and Kurlander faces multiple mail- and wire-fraud counts, punishable by up to 20 years in prison.

Bail was set at $500,000 for Kurlander and $250,000 for Abeshaus, both secured by property.

The U.S. Attorney's Office said the two men used their company, Easton, Pa.- based Circle System Group, to defraud schools and youth sports programs over a 10-year period ending in 2007. The company, which was bought by Schutt Holdings in 2005, according to the indictment, primarily reconditioned football helmets and shoulder pads for resale.

According to the indictment, the scam worked in a number of ways. For instance, the company allegedly sent schools monthly statements that looked like invoices, leading many schools to pay the same invoice twice. Prosecutors allege the company reaped nearly $1 million in overpayments this way, and kept most of the money.

The company is alleged to have created fake price quotes from competitors that Circle would undercut in order to win contracts. The indictment also accuses it of inflating invoices, sometimes to reimburse the company for money it had donated to the schools' fundraising and charity efforts.

Sacramento tax attorney to close law practice
Headline News | 2011/05/14 18:26
A tax attorney who called herself the "tax lady" will no longer be practicing law.

Roni Deutch says she will be closing her law firm of 20 years and will surrender her law license.

The Sacramento Bee reports that Deutch made the announcement Thursday, saying her firm has a debt of about $10 million, while she has personal debt of $5 million.

Deutch, a nationally known lawyer who gained a measure of fame on late-night television commercials, ran into legal problems when then-Attorney General Jerry Brown filed suit, accusing her of cheating clients out of $34 million.

Deutch was accused of destroying millions of pages of documents and failing to pay about $435,000 in refunds to clients.

She now faces hundreds of counts of contempt and possible jail time. A hearing on the contempt of court allegations is scheduled for July 22.

Slain neo-Nazi's beliefs could air in son's case
Legal Career News | 2011/05/14 17:23

White supremacist Jeffrey Hall saw threats in the protesters who demonstrated outside his Southern California house. He installed a surveillance camera pointed at the cul-de-sac outside the tidy home where strangers might approach.

The threat he feared, however, was not outside. It came, authorities say, from within the home: His 10-year-old son shot him to death last week.

Police arriving at the house in the early morning hours on May 1 for a report of gunfire found Hall's body on a sofa.

Prosecutors won't say if they know the motive, but family court records portray a troubled boy who spent his first years hungry and living in filth while his parents went through a messy divorce that included accusations of child abuse.

Evidence about how he was reared is likely to surface in a case that raises questions about whether the boy is mature enough to know right from wrong and whether his father's extremist views played a role in the shooting.

International court to seek Libya arrest warrants
Legal World News | 2011/05/13 14:22
An international prosecutor said Friday he will seek arrest warrants next week for three top Libyan leaders on charges of murder and persecution during their attempts to crush the uprising against Moammar Gadhafi's regime.

Luis Moreno-Ocampo, chief prosecutor of the International Criminal Court, did not release the names of the suspects, but Gadhafi himself is expected to be among them.

Moreno-Ocampo revealed broad details of his investigation last week to the U.N. Security Council, but the announcement was the first time the court specified the charges — murder and persecution, considered crimes against humanity under the Geneva Conventions.

Prosecutors say their investigation has identified "three individuals who appear to bear the greatest responsibility for crimes against humanity" committed in Libya since Feb. 15, when Gadhafi's forces began a brutal crackdown on anti-government rebels.

A panel of judges will review the prosecutor's evidence before deciding whether to issue the warrants. It is not clear how long the judges will take before reaching a decision.
