Court hears arguments on violent video games

The Supreme Court expressed sympathy for a California law that aims to keep children away from ultra-violent video games, but several justices said the law faces a high constitutional hurdle.

The high court heard arguments Tuesday over a California ban that would make it illegal for retailers to sell or rent violent video games to anyone under 18. Parents would be able to buy the games and give them to their children, but retailers who sell directly to minors would face fines of up to $1,000 for each game sold.

Several justices, including Antonin Scalia, Ruth Bader Ginsburg and Anthony Kennedy, noted that entertainment forms like comic books, movies, rap music and even children's fairy tales can also be violent but are not regulated by the state.

Those justices said the law, which has never been enforced, could be considered vague. They suggested that it might encroach on First Amendment rights.

But other justices seemed to dislike the notion that state officials should be powerless to keep children from buying a "deviant, violent" video game. They included Chief Justice John Roberts and Justices Samuel Alito and Sonia Sotomayor.



Ontario woman who faked cancer pleads guilty to fraud

An Ontario woman has pleaded guilty to keeping thousands of dollars in donations after faking terminal cancer.

Ashley Kirilow of Burlington was charged with six counts of fraud under $5,000 and one count of fraud over $5,000.

In a soft voice, Ms. Kirilow pleaded guilty to defrauding Donna Michalowski of close to $7,400 collected at a fundraiser held at a bar.

The other five charges will be addressed next year.

Police said the 23-year-old woman pretended to have cancer to raise money that she promised to give to charity, but kept the cash for herself.

Ms. Kirilow turned herself in to police on Aug. 6.

Her father has said she told him she shaved her head and eyebrows, and plucked her eyelashes to appear to have cancer.

When allegations surfaced against Ms. Kirilow, public outrage was swift.

Angry comments were splashed across the Facebook page set up for Ms. Kirilow's fake charity, Change for the Cure, with some even saying they hoped she got cancer.

One report published before Ms. Kirilow was charged had the young woman saying she was sorry for what she did.



Supreme Court strikes down NO cameras

The Louisiana Supreme Court has upheld a judge's order invalidating traffic tickets issued through New Orleans' red-light and speed-enforcement camera system

The court's 6-0 vote on Wednesday could create a budget problem for the city, which collected $9.4 million from the tickets through August and expected another $5 million through the end of the year.

On Oct. 1, a state judge tossed out the tickets, saying the camera system violated a city charter provision giving the police department sole authority to enforce traffic regulations. The program had been administered by the Public Works Department.

The Times-Picayune reports an ordinance has been introduced before the city council to transfer the program's authority to police.



Advocate appeals secret Kan. case to Supreme Court

An advocate for chronic pain patients who is under investigation for obstruction of justice has challenged grand jury subpoenas in a rare case that climbed secretly through the judicial system to the U.S. Supreme Court.

Siobhan Reynolds, president of the Pain Relief Network, has asked the nation's highest court to quash subpoenas issued to her and her nonprofit group and make public the proceedings against her. The usually public court docket - which includes court documents, hearing dates and other case information - has been sealed in her case in a federal district court in Kansas and 10th Circuit Court of Appeals.

Even at the U.S. Supreme Court, there was scant public record showing her case existed until last week, when the court agreed to make a redacted version of her appeal available while it decides whether to take the case.

Reynolds' attorney, Robert Corn-Revere of Washington, D.C., said the case is unusual because most secret proceedings involve some kind of national security and this one does not. Federal prosecutors have declined to talk about their reasons for pursuing the case in secret.



Arms dealer in Pentagon scheme guilty in new case

A Florida arms dealer convicted in a $300 million Pentagon scheme is pleading guilty to another federal weapons charge.

A plea agreement filed in Orlando federal court shows that 24-year-old Efraim Diveroli of Miami Beach will plead guilty at a hearing Tuesday to firearms possession by a convicted felon.

Prosecutors say Diveroli possessed numerous weapons and tried to broker a deal for thousands of rounds of ammunition and other weapons gear with undercover informants. Diveroli faces a 10-year maximum prison sentence in that case.

Diveroli previously pleaded guilty to conspiring to illegally ship Chinese-made ammunition to Afghan soldiers under a Pentagon contract. He is awaiting sentencing in Miami for that conviction.



Doctor Charged in Jackson's Death Back in Court

Los Angeles Superior Court Judge Michael Pastor scheduled the hearing to receive updates on attorneys' preparations for Murray's preliminary hearing, which is scheduled to begin in January. During that hearing, the judge will determine whether there is enough evidence for the cardiologist to stand trial.

Murray is accused of giving Jackson a lethal dose of sedatives, including the anesthetic propofol. He had been hired to serves as the singer's personal physician during a series of comeback concerts.
