Chapter 7 bankruptcy - The Bankruptcy Means Test

The means test makes it so that not everyone can simply file for bankruptcy and wipe out their debts. Those with a high amount of disposable income do not qualify. You will need to determine how your household income compares to the median in your state. If it is less, then you automatically qualify. If it is above the median, then you need to calculate your disposable income, which can get complicated.

When we calculate the means test, the formula allows certain amounts of expenses, and then the test calculates how much money you have left over. If it is higher than a certain amount, then you fail the means test. But, when we complete the means test, there are many items which vary for each person. We will use our experience to give you the best possible result to see if you qualify. It’s not simply plugging in a few numbers.

However, even if you do not qualify for Chapter 7 bankruptcy, you may still qualify for Chapter 13 bankruptcy, and the means test will determine how much of your debt you are required to pay back.

Chapter 7 for Individuals/

Chapter 7 bankruptcy is a good option for consumers who simply have too much debt and can not keep up with payments. They may have lost their job or come across unexpected expenses, such as medical bills or car repairs. If you take the means test and your income is below the median, then you qualify for Chapter 7 bankruptcy. If you want a fresh start, but do not have a regular income, Chapter 7 can wipe out the majority of your debts.

In this type of bankruptcy, we will consult with you to see what you own, and who you owe. We will then review your entire situation so that you know exactly what we expect will happen. In most cases, people can keep their house, car, and other household goods, and eliminate their unsecured debts.

A Trustee is assigned to review your case to see if you own more than you can protect. If you own more than what you are allowed to protect, the trustee may sell your assets, and use the proceeds to pay your debts. This happens in a very small number of cases.

Chapter 7 bankruptcy will wipe out unsecured debts such as credit card bills and medical bills. You are still on the hook for certain debts, such as tax debt, child support, alimony, and student loan debt. For student loan debt, you might be able to discharge that debt if you can prove that you have a permanent injury or illness that will prevent you from paying back your student loan debt. (Called the “Bruner” or “undue hardship” standard) Any attempt to discharge student loans are done in a separate and very difficult court proceeding.


Supreme Court leaves NC absentee ballot deadline at Nov. 12

The Supreme Court will allow absentee ballots in North Carolina to be received and counted up to nine days after Election Day. The justices, by a 5-3 vote Wednesday, refused to disturb a decision by the State Board of Elections to lengthen the period from three to nine days because of the coronavirus pandemic, pushing back the deadline to Nov. 12. The board’s decision was part of a legal settlement with a union-affiliated group.

Republicans had asked the high court to step in. Under the Supreme Court’s order, mailed ballots postmarked on or before Election Day must be received by 5 p.m. on Nov. 12 in order to be counted.  Chief Justice John Roberts and Justice Brett Kavanaugh joined the three liberal justices in the majority. Three conservative justices, Samuel Alito, Neil Gorsuch and Clarence Thomas, dissented. New Justice Amy Coney Barrett took no part in the case “because of the need for a prompt resolution and because she has not had time to fully review the parties’ filings,” court spokeswoman Kathy Arberg said.

North Carolina Attorney General Josh Stein, a Democrat whose office defended the deadline extension in court, hailed the high court’s decision in a statement. “North Carolina voters had a huge win tonight at the U.S. Supreme Court. The Court upheld the State Board of Elections’ effort to ensure that every eligible vote counts, even during a pandemic,” he said. “Voters must have their mail-in ballots postmarked by Election Day, but now we all have certainty that every eligible vote will be counted. Let’s vote!”

Republican state Senate leader Phil Berger said the high court’s order will undermine public confidence in government. “The question is simple: May unelected bureaucrats on a state panel controlled by one political party overrule election laws passed by legislatures, even after ballots have already been cast? If public confidence in elections is important to our system of government, then hopefully the answer to that question is no,” Berger said in a statement.

State and national Republican groups, including President Donald Trump’s campaign, had filed separate but similar appeals asking the high court to make the state revert to a Nov. 6 deadline for accepting late-arriving ballots that were postmarked by Election Day. That three-day timeframe was specified in state law.

The appeals, including one led by the state’s Republican legislative leaders, argued that the deadline change put in place by the State Board of Elections usurped legislators’ constitutional authority to set rules for elections. They also said the change made after early voting started would create unequal treatment of voters who had cast ballots under previous, stricter rules.

The State Board of Elections had lengthened the period as part of a late September legal settlement with the North Carolina Alliance for Retired Americans, a union-affiliated group represented by Marc Elias, a lawyer prominent in Democratic circles. The legal settlement, which also loosened requirements for fixing absentee ballots that lacked a witness signature, was approved by a state judge. The settlement said counties should have longer to accept ballots because of possible mail delays.



Supreme Court to review Trump's 'Remain in Mexico' policy

The Supreme Court is agreeing to review a Trump administration policy that makes asylum-seekers wait in Mexico for U.S. court hearings.

As is typical, the court did not comment Monday in announcing it would hear the case. Because the court's calendar is already full through the end of the year, the justices will not hear the case until 2021. If Joe Biden were to win the presidential election and rescind the policy, the case would become largely moot.

Trump's “Migrant Protection Protocols” policy, known informally as “Remain in Mexico,” was introduced in January 2019. It became a key pillar of the administration’s response to an unprecedented surge of asylum-seeking families at the border, drawing criticism for having people wait in highly dangerous Mexican cities.

Lower courts found that the policy is probably illegal. But earlier this year the Supreme Court stepped in to allow the policy to remain in effect while a lawsuit challenging it plays out in the courts.

More than 60,000 asylum-seekers were returned to Mexico under the policy. The Justice Department estimated in late February that there were 25,000 people still waiting in Mexico for hearings in U.S. court. Those hearings were suspended because of the coronavirus pandemic.


Appeals court keeps Flynn case alive, won’t order dismissal

A federal appeals court in Washington declined Monday to order the dismissal of the Michael Flynn  prosecution, permitting a judge to scrutinize the Justice Department’s request to dismiss its case against President Donald Trump’s former national security adviser.

The decision keeps the case at least temporarily alive and rebuffs efforts by both Flynn’s lawyers and the Justice Department to force the prosecution to be dropped without further inquiry from the judge, who has for months declined to dismiss it. The ruling is the latest development in a criminal case that has taken unusual twists and turns over the last year and prompted a separation of powers tussle involving a veteran federal judge and the Trump administration.

In a separate ruling Monday, a three-judge panel of the same appeals court again threw out a lawsuit by House Democrats to compel former White House counsel Don McGahn to appear before a congressional committee.

The Flynn conflict arose in May when the Justice Department moved to dismiss the prosecution despite Flynn’s own guilty plea to lying to the FBI about his contacts with the Russian ambassador during the presidential transition period.

But U.S. District Judge Emmet Sullivan, who had upbraided Flynn for his behavior at a 2018 court appearance, signaled his skepticism at the government’s unusual motion. He refused to dismiss the case and instead scheduled a hearing and appointed a retired federal judge to argue against the Justice Department’s position. That former judge, John Gleeson, challenged the motives  behind the department’s dismissal request and called it a “gross abuse” of prosecutorial power.

Flynn’s lawyers sought to bypass Sullivan and obtain an appeals court order that would have required the case’s immediate dismissal. They argued that Sullivan had overstepped his bounds by scrutinizing a dismissal request that both sides, the defense and the Justice Department, were in agreement about and that the case was effectively moot once prosecutors decided to abandon it.

At issue before the court was whether Sullivan could be forced to grant the Justice Department’s dismissal request without even holding a hearing into the basis for the motion.

“We have no trouble answering that question in the negative,” the court wrote in an unsigned opinion for the eight judges in the majority.



1st Black woman confirmed to be justice on NJ high court

The nomination of the first Black woman to sit on New Jersey’s Supreme Court was confirmed Thursday by the state Senate.

Fabiana Pierre-Louis, a 39-year-old attorney in private practice and a former federal prosecutor, was nominated by Democratic Gov. Phil Murphy in June to succeed Justice Walter Timpone. He was nominated to the court by former Republican Gov. Chris Christie in 2016 and will reach the mandatory retirement age of 70 later this year.

“Ms. Pierre-Louis is a New Jersey success story who will bring more diversity to the highest court of the most diverse state in the country,” said Senate President Steve Sweeney, also a Democrat. She is Murphy’s first pick for the high court.

The daughter of Haitian immigrants, Pierre-Louis was the first person to go to law school in her family. At the event in Trenton in June with Murphy, she seemed to get choked up talking about the role they played in her life.

“Many years ago, my parents came to the United States from Haiti with not much more than the clothes on their backs and the American dream in their hearts. I think they have achieved that dream beyond measure because my life is certainly not representative of the traditional trajectory of someone who would one day be nominated to the Supreme Court of New Jersey,” she said.

Pierre-Louis is a partner at Montgomery McCracken in Cherry Hill, where she is in the white collar and government investigations practice.

Before that, she served for nearly a decade as an assistant United States Attorney in New Jersey.

As part of that role, she served as the attorney-in-charge of the Camden branch office — the first woman of color to hold that a position, according to her biography on Montgomery McCracken’s website.

Murphy, a Democrat, said that Pierre-Louis would carry on the legacy of John Wallace, who was the last Black justice on the state’s highest court and who she clerked for.

Murphy lamented that Wallace was not renominated when his first term expired in 2010 — the first time that had happened under the state’s current constitution.


Appeals court revives House lawsuit for McGahn's testimony

A federal appeals court in Washington on Friday revived House Democrats' lawsuit to force former White House counsel Don McGahn to appear before a congressional committee, but left other legal issues unresolved with time growing short in the current Congress.

The full U.S. Court of Appeals for the District of Columbia Circuit voted 7-2 in ruling that the House Judiciary Committee can make its claims in court, reversing the judgment of a three-judge panel that would have ended the court fight.

The matter now returns to the panel for consideration of other legal issues. The current House of Representatives session ends on Jan. 3. That time crunch means “the chances that the Committee hears McGahn’s testimony anytime soon are vanishingly slim," dissenting Judge Thomas Griffith wrote. Judge Karen LeCraft Henderson also dissented.

The Judiciary Committee first subpoenaed McGahn in April 2019 as it examined potential obstruction of justice by President Donald Trump during special counsel Robert Mueller’s Russia investigation. Trump directed McGahn not to appear and the Democratic-led panel filed a federal lawsuit to force McGahn to testify.

A trial judge ruled in November that the president’s close advisers do not have the absolute immunity from testifying to Congress that the administration claimed. Griffith and Henderson formed the majority when the appellate panel said in February that the Constitution forbids federal courts from refereeing this kind of dispute between the other two branches of government.

On Friday, the full court said the panel reached the wrong decision. Lawmakers can ask the courts “for judicial enforcement of congressional subpoenas when necessary," Judge Judith Rogers wrote. Congress needs detailed information about the executive branch for both oversight and impeachment, she wrote.

House lawmakers had sought McGahn’s testimony because he was a vital witness for Mueller, whose report detailed the president’s outrage over the investigation into Russian interference in the 2016 election and Trump’s efforts to curtail it.

In interviews with Mueller’s team, McGahn described being called at home by the president on the night of June 17, 2017, and being directed to call the Justice Department and say Mueller had conflicts of interest and should be removed. McGahn declined the command, deciding he would resign rather than carry it out, the report said.
