Clinton: Americans should put Court nomination at forefront

Hillary Clinton wants voters to consider what Republican front-runner Donald Trump might do to shape the Supreme Court.
Clinton planned to use in a speech in Madison, Wisconsin, on Monday to argue that Trump could roll back the rights of individuals, further empower corporations and undo some of the nation's progress.
Clinton was campaigning in Wisconsin ahead of the state's April 5 primary and speaking Monday at the University of Wisconsin about President Barack Obama's nomination of Judge Merrick Garland.
Clinton holds a large lead among delegates against Democratic rival Bernie Sanders but is trying to stamp out the Vermont senator's momentum following his victories in five of the last six states holding contests.
Clinton's campaign said ahead of the speech that the Democratic presidential candidate would call on Senate Judiciary Chairman Charles Grassley of Iowa to commit to giving Garland a hearing. Grassley and Senate Majority Leader Mitch McConnell, R-Ky., have said that the late Justice Antonin Scalia should not be replaced until the next president picks a nominee.

Texas man executed for killing city code enforcement worker

A Texas man on death row for killing a worker who was on his property looking for city code violations was put to death Tuesday.
Adam Ward was given a lethal injection for shooting and killing Michael Walker, a code enforcement officer who was taking photos of junk piled outside the Ward family home in Commerce, about 65 miles northeast of Dallas.
Ward insisted the 2005 shooting was in self-defense, but the 44-year-old Walker only had a camera and a cellphone.
Ward's attorneys, both at his trial and later for his appeals, described him as delusional and mentally ill. Hours before his execution, the U.S. Supreme Court rejected an appeal that argued his mental illness should have disqualified him from the death penalty.
The 33-year-old Ward thanked his supporters, expressed love for his parents who did not attend the execution and said he hoped "some positive change can come from this."
But he insisted the shooting was not a capital murder case.
"This is wrong what's happening," he said. "A lot of injustice is happening in all this. I'm sorry things didn't work out. May God forgive us all."
He was given a lethal dose of pentobarbital and as it took effect, he took a deep breath followed by a smaller one. He then stopped moving.
He was pronounced dead at 6:34 p.m. CDT — 12 minutes after the drug started to flow into him.
Ward became the ninth convicted killer executed this year nationally and the fifth in Texas, which carries out capital punishment more than any other state.
In their appeal to the Supreme Court, Ward's attorneys argued the high court's ban on executing mentally impaired prisoners should be extended to include inmates like Ward who have a severe mental illness and that putting him to death would be unconstitutional because of evolving sentiment against executing the mentally ill.
The justices have ruled mentally impaired people, generally those with an IQ below 70, may not be executed. However, the court has said mentally ill prisoners may be executed if they understand they are about to be put to death and why they face the punishment. |

Court records: Apple's help sought in another iPhone case

A federal magistrate in Chicago last November ordered Apple to help federal prosecutors access data on an iPhone in a personal bankruptcy and passport fraud case, one of more than a dozen cases around the country similar to the legal battle over the telephone of one of the San Bernardino shooting suspects.
Court records show U.S. Attorney Zachary Fardon filed a November 2015 motion saying law enforcement needed Apple's help to bypass the passcode to search, extract and copy data from an iPhone 5S owned by Pethinaidu and Parameswari Veluchamy, the Chicago Tribune reported.
An affidavit filed Nov. 13 said text messages, phone contacts and digital photos might help confirm wrongdoing. It also said data on the phone "may also provide relevant insight into the cellphone owner's state of mind as it relates to the offense under investigation."
The Chicago Sun-Times reported that U.S. Magistrate Judge Mary Rowland's order said Apple should provide authorities "reasonable technical assistance to enable law enforcement agents to obtain access to unencrypted data" She added Apple "may provide a copy of the encrypted data to law enforcement, but Apple is not required to attempt to decrypt, or otherwise enable law enforcement's attempts to access any encrypted data."

Court to weigh cocaine cases, could alter sentencing in Ohio

Prosecutors across Ohio are concerned that a ruling under review by Ohio's top court could delay and shorten sentences for suspects caught with cocaine and force costly changes upon law enforcement.
The state Supreme Court will hear arguments Tuesday on whether to uphold an appeals court decision calling into question how prosecutors have handled cocaine cases for years. It all comes eastdown to weight.
A state appeals court in Toledo ruled last year prosecutors should have determined how much pure cocaine a suspect arrested in a drug sting had with him or her instead of sentencing him based on the weight of the entire amount.
The appeals court ruled that Ohio's drug laws say that what matters is the weight of the cocaine only ? not filler material such as baking soda that's often added by drug dealers to stretch out their supply and increase profits.
Prosecutors along with the state Attorney General's office argue that such a narrow interpretation creates a new distinction for cocaine that isn't applied to any other illegal drugs.

High court seems skeptical of mandatory public union fees

The Supreme Court appears ready to deliver a major setback to American unions as it considers scrapping a four-decade precedent that lets public-sector labor organizations collect fees from workers who decline to join.
During more than an hour of oral arguments Monday, the high court's conservative justices seemed likely to side with a group of California teachers who say those mandatory fees violate the free-speech rights of workers who disagree with a union's positions.
Labor officials fear unions' very existence could be threatened if workers are allowed to get all the benefits of representation without at least paying fees to cover the costs of collective bargaining. The case affects more than 5 million workers in 23 states and Washington, D.C.
But Justice Anthony Kennedy rejected arguments by lawyers for the state of California and the California Teachers Association that the current fee system is needed to prevent non-members from becoming "free riders" ? workers who reap the rewards of union bargaining and grievance procedures without paying for it.
"The union basically is making these teachers compelled riders for issues on which they strongly disagree," Kennedy said, noting the political nature of bargaining issues like teacher salaries, merit promotions and class size.

Man run over by Suge Knight says he punched ex-rap mogul

A man who Marion "Suge" Knight ran over told authorities he was upset with the former rap music mogul and punched him through the window of the truck before a deadly encounter that left his friend dead.
Cle "Bone" Sloan testified Monday about the day he and friend Terry Carter were hit by a pickup truck driven by Knight, the co-founder of Death Row Records.
But Sloan refused to identify Knight as the man behind the wheel when he was struck outside a Compton burger stand on Jan. 29. He said he didn't remember specifics of the fight and does not want to be a "snitch."
"I will not be used to send Suge Knight to prison," Sloan, an adviser on the upcoming film "Straight Outta Compton," said, adding that he was only on the stand because he was subpoenaed.
Sloan's testimony was offered during a preliminary hearing Monday during which a judge will determine whether there's enough evidence for Knight to stand trial on murder, attempted murder, and hit-and-run charges. Authorities contend Knight intentionally hit Sloan and Carter. But Knight's attorney Matt Fletcher says his client was ambushed and was trying to escape an attack when he hit the men. |
